What are the steps involved in lodging a complaint?

Step 1: 

If you believe a publication – print or online – has not lived up to the Code of Ethics and Conduct for South African Print and Online Media, you may lodge a complaint online or by letter, fax, sms or e-mail with the Press Council’s Public Advocate within 20 working days of the publication of the relevant story.

If necessary, the Public Advocate will assist you in formulating your complaint. The Public Advocate will also act as your champion throughout the process, arguing your matter before the Ombud and the Appeals Panel, if it reaches that level. In the complaint, state the name and date of the publication and the reasons you believe  it breached the Code. If you send a copy of the article with the complaint, it would speed up the process.

Step 2:

The Public Advocate will negotiate with the publication on your behalf to attempt a speedy settlement.

Step 3:

If no resolution is achieved within 15 working days of the publication receiving notice of the complaint, the Public Advocate will refer the matter to the Ombud for adjudication. The Ombud may hold a hearing and will be assisted by two members of the Panel of Adjudicators – a media representative and a public representative – at the hearing. Decisions will be by majority vote.

Step 4:

If either party is not satisfied with the decision, it may take the matter on appeal to the Chair of Appeals, retired Gauteng Judge President Bernard Ngoepe. The judge will also hear the appeal with a media representative and up to three public representatives from the Panel of Adjudicators.

Step 5:

If either party is not satisfied with the decision of the Chair of Appeals, it may ask the courts to review it.

Isinyathelo 3:

Uma kungekho sisombululo phakathi kwezinsuku eziyi -15 emva kokuba iphephandaba lathola isikhalazo, iPublic Advocate izodlulisela lolu daba ku-Ombud ukuze ilunqume. I-Ombud ingalalela leso sikhalazo bese isizwa ngamalungu amabili wePanel of Adjudicators – omele abezomthombo wezindaba kanye nomele umphakathi – lapho kulalelwa isikhalazo leso. Izinqumo zothathwa ngokuvotwa, iningi yilona elizodla umhlanganiso.

Uma amaqembu omabili engasithakaseli isinqumo, isicelo singadluliswa siqondiswe ku-Chair of Appeals, iJaji laseGauteng eselathatha umhlalaphansi, uJudge President Bernard Ngoepe. IJaji lizolalela isicelo nomele abezomthombo wezindaba kanye nabamele umphakathi abangaba bathathu abakuPanel of Adjudicators.

Uma amaqembu omabili engasithokozeli isinqumo seChair of Appeals, kungenzeka kucelwe izinkantolo ukuba sisibuyekeze

Stappe by die lê van ’n klag

Stap 1: 

As u glo dat ’n publikasie – gedruk of aanlyn – Die Perskode vir Etiek en Gedrag vir die Suid-Afrikaanse druk- en aanlynmedia verbreek het, kan u ’n klag aanlyn of per brief, faks, SMS of e-pos by die Persraad se Openbare Advokaat aanhangig maak. Dit moet binne 20 werksdae van die publikasie van die betrokke storie gedoen word.

Indien nodig, sal die Openbare Advokaat u help om u klag te formuleer. Die Openbare Advokaat sal ook as u kampvegter gedurende die proses optree en u saak voor die Ombud en die Appèl-paneel verdedig, sou dit daardie stadium bereik. Noem die naam en datum van die publikasie in u klag en verskaf ook redes waarom u meen dat dit die Perskode verbreek het. Dit sal die proses bespoedig as u ’n afskrif van die storie saam met die klag stuur.

Stap 2:

Die Openbare Advokaat sal namens u met die publikasie onderhandel in ’n poging om ’n spoedige skikking te bewerkstellig.

Stap 3:

Indien geen sodanige skikking bereik is binne 15 dae nadat die publikasie van u klag in kennis gestel is nie, sal die Openbare Advokaat die saak na die Ombud vir ’n beslissing verwys. Die Ombud kan ’n verhoor hou en sal bygestaan word deur twee lede van die Paneel van Beoordelaars – ’n verteenwoordiger van die media en van die publiek. Besluite word deur ’n meerderheidstem bepaal.

Stap 4:

Indien enige van die partye nie tevrede is met bogenoemde uitkoms nie, kan die saak op appèl na die Appèl-voorsitter, die afgetrede Gautengse regter-president Bernard Ngoepe, geneem word. Die regter sal ook die saak met ’n verteenwoordiger van die media en tot drie publieke verteenwoordigers van die Paneel van Beoordelaars aanhoor.

Stap 5:

Indien enige van die partye nie tevrede met die besluit van die Appèl-voorsitter is nie, kan die saak vir hersiening na ’n hof geneem word.
